A New Law Will Be Approved To Protect Algerians’ Personal Data On Social Networks

Justice Minister, Tayeb Louh, revealed on the new measures to secure and protect the personal data of individuals, which were monitored and exploited by national and foreign parties, asserting that the pictures of the Algerians and their private data that are included in Facebook and Twitter, and even the files of the visa will be protected, and can not be uncovered without permission of the concerned persons, as this will be applied after the approval of the new draft law.

On the sidelines of the discussion of a draft law on the protection of natural persons in the field of processing personal data, the minister said Wednesday that the privacy of Algerians was exploited earlier by unknown parties, adding that the text of the new project will end these abuses, and will allow Algeria to ask foreign countries to obtain information on suspicious persons and file their files, especially since this procedure is currently prohibited, as Article 7 states: “Personal data can only be processed with expressing consent of the concerned persons.”

If the article is violated the penalty is imprisonment from one year to three years and a fine of 10 million to 30 million for each one who exploited data of personal nature, and everyone who exploits personal data shall be punished despite the objections of the concerned person.

The same procedure is true for children, as the Justice Minister emphasized that personal data relating to kids can only be processed after obtaining the consent of his or her legal representative, if necessary, with the authorization of the competent judge, saying: “The judge may process the data even without the consent of his legitimate representative, if the kids’ services need it.”

The draft law envisages the creation of the National Authority for the Protection of Personal Data, consisting of 16 persons, who are selected by the President of the Republic with competence, three judges who are proposed by the Judicial Supreme Council from the Supreme Court and the State Council, with a member of each Chamber of Parliament, a representative of National Council for Human Rights, representative of Ministries: Defense, Foreign Affairs, Interior, Justice, Post, Health and Labor.

The Minister revealed on the creation of a national registry for the protection of personal data that is led by the national authority, and in accordance with article 28 of the text of the draft law, “the files that the public authorities are responsible for processing, the necessary data to allow the concerned persons to exercise their rights under the law, and the national register excludes the files with the sole purpose of treating a register that is directed
