Criminal Investigation Concerning Said Bouteflika, Tartag and Tewfik Is Dragging Others To Military Court

The defense counsel of the defendants, Said Bouteflika, the brother and adviser to the former president, former intelligence chief Mohamed Mediène called Tewfik, as well as the former intelligence coordinator General Bachir Tartag and the secretary general of the Workers’ Party, Louisa Hanoune, have sought guarantees of compliance in the same jurisdiction whenever necessary.
The defense lawyers filed the request on Sunday, after the defendants had been indicted before the military investigating judge, who heard them for the second time on the case last week, as revealed by informed sources to “Echorouk”.
The military judge did not drop any charge against the four defendants, but proved the first charges related to the criminal Conspiracy to attack the authority of a commander of a military formation “, the act established and punishable by article 284 of the Military Justice Act, and the second:” the crime of conspiracy aimed at dealing a blow to the authority of a military commander, “the act prescribed and punishable by article 284 of the Military Justice Act and the penalty of 5 to 10 years A prison.
The second charge is: “Conspiracy to change the regime”, the act provided and punishable by article 77 of the Penal Code and punishable by death. ”
In this context, lawyer Boudjemaa Ghachir, a member of the defense of the general secretary of the Workers’ Party, told Echorouk that the application for the release of Louiza Hanoune had already been submitted to the Military Justice Judge, whom he heard for the second time on the “matter” last week.
The request is accompanied by guarantees relating to the undertaking of his client to appear whenever the investigation so requires, and to comply with all the provisions relating to judicial supervision, in accordance with the Military Justice Law.
The Military Court had rejected the appeal lodged by the defense of the four accused in the same indictment chamber of the same court and those detained since 4 May for the trio, Said Bouteflika, Tartag and Tewfik and since 9 May for Louisa Hanoune.
Louisa Hanoune, Secretary General of the Workers’ Party, is accused of conspiracy to change the regime and to undermine the authority of the commander of a military formation.
Crimes punishable by 10 years in prison and up to the death penalty. Louisa Hanoune’s lawyer revealed, in a statement, that the charges brought by the military justice against her client are: “conspiracy to undermine the authority of the commander of a military formation” (article 284 of the Military Justice Code) and “conspiracy to change the regime” (an act provided for and punished by article 77 of the Criminal Code).
He added that that Louisa Hanoune is being prosecuted by the military courts in the same case as Said Bouteflika and General Mohamed Mediène (General Toufik) and Athmane Tartag.
Saïd Bouteflika, Louisa Hanoune and generals Mohamed Mediène and Athmane Tartag could face heavy penalties if their guilt is proven. Convictions can range from 5 to 10 years’ criminal imprisonment on the charge of “conspiracy to violate the authority of the commander of a military formation”.
They may even be sentenced to death if the military justice system charges them with “conspiracy to change the regime”.
