How is Employees’ Professional Experience Calculated in All Sectors?

The Public Service confirmed that prior professional experience gained by employees before their new employment can be counted, regardless of any overlap between the date of resignation and the date of reappointment, provided that only the actual period of service is taken into account.

The clarification published in an official response, reviewed by Echorouk, addressed to MP Moussa Kharfi, dated November 13. Kharfi had requested a precise explanation of the mechanisms for calculating seniority in cases of employee transfers between different sectors, as well as the calculation of professional experience allowances for employees who held various positions in multiple sectors and institutions, given the overlap between their resignation dates and re-employment dates.

In its response to the MP’s question, the Public Service confirmed that seniority acquired before employment is taken into account when calculating professional experience allowances, in accordance with the provisions of Article 16 of Presidential Decree No. 07-304, dated September 29, 2007, which establishes the salary scale for public servants and their amended and complemented payment system.

The Public Service stated that, in accordance with the provisions of Circular No. 02 dated March 13, 1989, which specifies the procedures for implementing Decree No. 85-5 dated March 23, 1985, concerning compensation for professional experience acquired before the employee’s appointment to their current position, is calculated at half the duration. If the previous rank was lower in classification than the current rank, and at full duration, if it was equal to or higher in classification.

Furthermore, in accordance with the same publication, the Public Service, specifically point 3-2, paragraph “D” thereof, adds that the recognition of professional seniority acquired in sectors other than the public service, as per its response, is based on membership certificates issued by the National Social Security Fund to which the employees concerned are affiliated.

Based on the response, professional seniority acquired in the private sector is counted at half. In this case, those concerned must submit a work certificate issued by their employer, in addition to a membership certificate issued by the National Social Security Fund.

In its response to the MP, the Public Service added that professional experience acquired before employment is considered within the framework of professional experience compensation after an employee’s official appointment. This experience is calculated based on the maximum period for promotion, set at 3 years and 6 months, outside the scope of the Joint Administrative Committee, and regardless of the promotion rates stipulated in Presidential Decree No. 07-304 of September 29, 2007, which establishes the salary scale and the amended payment system for public servants.

To preserve the acquired rights of those concerned, the public service confirmed that professional experience acquired before the new employment can be counted, regardless of any overlap between the date of resignation and the date of reappointment to a public service position, provided that the period actually performed is taken into account and is counted up to the date of the new appointment.
