Presentation Of Government’s Action Plan Postponed Until Further Notice
The legal deadlines forced the new government to adjourn the presentation of its plan of action, which was expected to be discussed in a free-wheeling by the National People’s Assembly starting from of the 18th of June, as confirmed by the services of Prime Minister Abdelmadjid Tebboune earlier this week.
The delay in the convening of the Council of Ministers and the delay in the installation of the various structures of the National People’s Assembly has put off the presentation of the plan of action of the Tebboune Government before the deputies, according to “Echorouk” sources.
Prime Minister Abdelmadjid Tebboune was thus expected to present his program of action in the coming days in accordance with Article 94 of the revised Constitution of February 2016. The government’s action plan is in line with the implementation of the national development program of the President of the Republic. The government is responsible for its close follow-up and its smooth implementation.
In this sense, article 94.37 of the Constitution stipulates that “the Prime Minister submits the government’s action plan to the approval of the National People’s Assembly. To this end, it opens a general debate. The Prime Minister may adapt this plan of action in the light of this debate, in consultation with the President of the Republic “.
The same article states that “the Prime Minister shall submit to the Council of the Nation a communication on the Government’s action plan as approved by the National People’s Assembly. The Council of the Nation may issue a resolution “.
Article 95.38 adds that “if the government’s action plan is not approved by the National People’s Assembly, the Prime Minister presents the resignation of the government to the President of the Republic. The latter shall reappoint a Prime Minister on the same terms “.
This possibility is to be discarded insofar as Mr Abdelmadjid Tebboune, who hails from the FLN party, will see the government’s program adopted by the Assembly.
The FLN and the RND parties, by themselves, constitute the majority in the National people’s Assembly not to mention the other pro-establishment parties such as TAJ, ANR, el Moustakbal Front and of course the MPA, who are expected to also endorse, without fail, the proposed Government’s action plan.
Article 98.39 of the Constitution also emphasizes that “the government must present annually to the National People’s Assembly a general policy statement.
The policy statement gives rise to debate on government action. This debate can be completed by a resolution. It may also give rise to the filing of a motion of censure by the National People’s Assembly in accordance with the provisions of Articles 153, 154 and 155 below.
The Prime Minister may ask the National People’s Assembly for a vote of confidence. If the motion of confidence is not passed, the Prime Minister presents the resignation of the Government. In this case, the President of the Republic may, before acceptance of the resignation, make use of the provisions of article 147 of the Constitution. The Government may also be required to submit to the Council of the Nation a declaration of general policy “.
