Belaiz calls for expanding the powers of the Constitutional Council

Head of the French Constitutional Council, Jean-Louis Dupree, confirmed the need to deprive the judge of feeling the weight of responsibility towards the others, so that his decisions will be subject to his conscience and of no one else, and criticized the way the political choices by the members of the Constitutional Council.
Former head of the French association said in his speech on the topic “notification through the payment with unconstitutionality; ”The man of justice in general and the members of the Constitutional Council, in particular, urgently need to be liberal personalitiesand indifferent, and independent of any party, including the one which appointed them.
Dupree asserted that controlling body should not bia tothe regulatory power that contributed to its composition, when making any decisions, as he defended the enjoyment of the members of the Constitutional Council with the necesary legal proffesionalism, to perform their function, and not to give political explanations of laws, considering that this body often does not specify laws that referred to it, according to their conformity with the Constitution, but it determined it in accordance with the political choices of the members of this body.
For his part, the President of the Constitutional Council, Tayeb Belaiz, that expanding the notification to other parties has become a “democratic requirement and will allow strengthening the Council’s role in contributing to the protection and promotion of the rightsand freedoms.”
Belaiz explained in the opening speech of the school day that was organized by the Constitutional Council on Monday, on the theme “Expanding the notification of the Constitutional Council” , that to extend this procedure to other parties “has becometoday’s democratic requirement not only by the political class, but also the legal scholars believing that it will strengthen the role of te Council to contribute more together with other institutions in the protection and promotion of rights and freedoms.”
In the opinion of jurists, the system of the Algerian Constitution noticed delays in expanding notification to the Constitutional Council in view of the systems in many countries, as many countries noticed a step forward in its constitutional notification, a case of the French experience presented by the President of the French Constitutional Council, which grants the right of parliamentariansand citizens in notification of the constitutional Council.
