European Union Does Not Recognise Morocco's Alleged Sovereignty Over Western Sahara

Attorney General of the European Union’s Court of Justice, Melchior Whatelet, sent on Tuesday, a surprising blow to Morocco, while it was a victory for the Western Sahara people, when he said: “Agreement between the EU and Morocco about releasing the exchange of agricultural and fishing products, cannot be applied on the Western Sahara, because it is not affiliated the Moroccan territory”.

Lawyer Melchior Whatelet wrote in its conclusions that “(…) Western Sahara does not belong to the Moroccan territory, and contrary to what was observed by the Court of Justice, there is neither a partnership agreement between the EU and Morocco, nor an agreement to release products that can be applied on Western Sahara”.

In his recommendation to the court, which is scheduled to deliver its verdict later in, the Attorney General of the European Court of Justice explained that neither the European Union nor any other country of its members, recognise Morocco’s alleged sovereignty on Western Sahara since 1963 in the United Nations list of non-independent Territories.

“European Union and its Member States have never admitted that the Western Sahara belongs to Morocco’s sovereignty”.

In this context, the same official asserted; “Western Sahara is listed since 1963 within the UN list of Non independent territories, and it is therefore subject to the application of UN resolution which states the right of of colonised peoples to self-determination”. 

“International law does not allow expending the field of applying the bilateral treaties on other territories. Western Sahara precisely constitutes another territory for the Union and Morocco”.

Previously, the Polisario Front said it is ready to launch “frank and sincere” dialogue with the European Nation’s Council and Office after the conclusions of the EU’s Attorney General, Melchior Whatelet in the case that was raised before the Court of Justice of the European Union on the cooperation agreement in the field of agriculture and fisheries between the EU and Morocco, pending the judgement of the European Court in this regard.
