Algeria lost during the last ten years, over $ 3.5 billion, in cases where the partners have resorted to international arbitration, as the majority of cases that are brought to arbitration lost even before they are lifted, because the local party does not respect the terms of the contract agreement, and deals on the grounds that the owner is always right, the manager and the owner of the institution, and not the partner who should respect the second party, Echorouk sources said.
Despite the fact that the agreement on the arbitration has an utmost importance, but it is considered the foundation stone of the arbitration dispute, as the Algerian legislature adopted two pictures of arbitration agreements, in order to give opponents the right to resort to arbitration, if a dispute between the two erupted, whether previously or subsequently to the agreement.
Legislature also tried to determine the content of arbitration agreements in order to prevent opponents from evading their obligations, but the national institutions rarely resort to international arbitration, or is required or to be a opposite party.
