France Ratifies Extradition Convention With Algeria

From now onwards, the extradition convention for wanted persons between Algeria and France is published in the French Official Journal.

Publication in the OJ of the law authorizing the approval of the extradition convention between the government of the French Republic and the government of the People’s Democratic Republic of Algeria, reported Monday the newspaper Le Monde.

Article updated on 23 March 2021. On 27 January 2019, the Algerian and French Ministers of Justice signed in Algiers the extradition convention between the respective governments of the two States.

The Minister for Europe and Foreign Affairs presented a bill authorizing the approval of the extradition convention between the Government of the French Republic and the Government of the People’s Democratic Republic of Algeria.

On 27 January 2019, the Algerian and French Ministers of Justice signed in Algiers the extradition convention between the Government of the French Republic and the Government of the People’s Democratic Republic of Algeria.

This convention aims to establish enhanced and more effective cooperation between France and Algeria in the fight against crime, leading to the effective and more rapid surrender of wanted persons in order to prosecute them or enforce their prison sentences, by replacing the provisions of the convention on exequatur and extradition of 27 August 1964 on extradition.

To this end, this new treaty framework makes it possible, while respecting each other’s national rules and international commitments, to rationalize and modernize the existing legal framework in order to adapt it to the operational needs that have evolved since 1964.

In particular, this agreement makes it possible to deal with the problem linked to the existence in Algerian legislation of the death penalty, which has since been abolished in France, and which could prevent the surrender of wanted persons in the absence of diplomatic assurances that are deemed sufficient.

This agreement mechanism aims mainly to develop friendly relations between Algeria and France, in addition to strengthening bilateral cooperation, in the field of investigation and prosecution, and combating crime, as borders do not constitute an obstacle to a person’s escape from punishment.
