Muammar Gaddafi's PM Al Baghdadi Beaten, his lawyer says
Al Bachir Assayd, defense lawyer of al-Baghdadi al-Mahmoudi, former Prime Minister in the regime of Muammar Gaddafi, said his client was tortured and humiliated in the most horrendous ways, and confirmed in a phone contact with Echorouk from Tunisia, that he will defend him strongly, adding that the Tunisian government will be responsible of any inflict or harm against him, and skeptical about the reaction of the President Marzouqi .
-First of all, what is your comment to the statement of Tunisia president, which confirms the non legitimacy of the decision of deportation, which holds responsibility on the PM Al Djibali?
* If we look at the issue of Al Baghdadi from a legal point of view,, the Tunisian law is clear and had specific tasks. No official can decide about the deportation decision, except the President. The section 324 of the Code of Criminal Procedures defined this task. The opinion of Justice is merely advisory, and not a prohibited judgment, because the executive branch is a sovereign political decider, signed by the president stating whether or not he will be deported. We emphasize that the prime minister exceeded his powers and flipped the powers of the President, therefor the decision of delivery is false. At the same time, the decision of the President of the government creates a constitutional crisis in Tunisia, a crisis of conflict in powers, and the case is presented before the National founding council for consideration.
-Will Marzouqi and his criticism of the PM add any new development in the case of al Baghdadi,who was really handed over to Tripoli?
* President Moncef Marzouki’s protest was merly & media play no more, and it is more likely that what happened was an exchange of roles between the president and the prime minister, and therefore I believe that the Constituent Assembly will discuss the issue, but it will not go away because I expect that he will close the matter.
-Are there any news about Al Baghdadi’s situation? Are there any real guarantees that were announced by al Djabali in previous times?
* Unfotunately, I heard hours ago that al-Baghdadi was subject, from the moment of his arrival to Libya, to torture by militias or those who call themselves “fighters”, before he was deported to the Military Academy in Casablanca. According to information I received from there, the assault was in the presence of officials. as his body was covered with spat and hit on the head and was dragged until he became unconscious, then taken to hospital. I received news at the end of the day about his presence is intensive care, after his health condition worsened, especially since he suffers many diseases, including diabetes.
