Killer of The Kid Sheima Yousefi Got Death Penalty

Criminal Court at the Judicial Council of Tipaza sentenced the death penalty against the killer of Shaima Yousfi, 8, in the neighbourhood of Maalma in Zeralda, on December 2012, after kidnapping, raping and killing her deliberately with premeditation, and forced her to pay one million dinars for the victim’s parents.

Trial’s proceedings started, on Wednesday, at 10:20 am, where the Chairman of the Criminal Court called the defendant “M.Hamza”, who was surrounded by elements of the security services, and the father of the victim Shaima, and also witnesses who were all absent, but a cousin of the kid Shaima.

After reading the referral’s decision, the defendant recognized, across all the stages of the investigation, the acts that are attributed to him, including the abduction of the girl and sexual abuse, before strangling her with a cloth.

Chairman of the Court asked the defendant to state the facts from the beginning, and he denied everything that came in the referral decision, and tried boldly to lie, and said that on the day of the crime he was drunk and was not aware of the murder that occurred in the neighbourhood, and that he had a good relationship with the father of Shaima, and when the judge asked him about the reason of his escape, he replied; “I Feared of the neighbours’ punishment, after the news of committing the crime, and all the people were looking for him”, then he asked him again; “Why did not you resort to the gendarmerie or security services? He Tried to evade the judge’s question, who faced him with strong evidence that condemned him, and provide all the scientific evidence and analysis, but the defendant continued for a period of about an hour of time, trying to deny and evade of the evidence that the judge presented to him.

The judge then called the victim’s father, who burst into tears and found it difficult to speak, and said that his daughter claimed was the victim of safety which the killer provided to her before raping and killing her, adding that he had good relationships with the killer and opened the doors of his house to him, but he betrayed him and killed his daughter, adding that he lived hard times with his family.

Attorney General focused in his arguments on the unequivocal evidence that prove the heinous and brutal crime which he committed, and his confession at all stages of the investigation with all the acts that were attributed to him, and the scientific evidence that commensurate with the killer’s statements, and the analysis of DNA sperm, which are all signs that confirm the crime and sought the death penalty in his case.

Defence of the accused “M.Hamza” said that defending the accused is not a personal conviction, but for legal requirements, on the grounds that drugs and alcohol are the cause of crime among the youth, and sought non guiltiness for his client for the benefit of the doubt.
