French Authorities To Re-Grant Nationality For Algerians Born In France Before January 1963

French authorities issued an instruction to their services across the provinces to re-grant the French nationality to Algerians who were born in France before January,1, 1963 from parents who were subject to the civil status of local law and their Algerian origins, and lost French citizenship before January 1, 1963.

The announcement came in response to the French Interior Ministry, dated on September, 21 on the written accountability of the Senator Brigitte Micouleau (Republicans) dated 6, July on the conditions for the granting of French nationality to foreigners.

The response, which copy is available to Echorouk, said that the French government asked the representatives of the state through the provinces via an instruction dated on October 2016, to give particular attention to the requests for the re-granting of nationality to this category if the person concerned or his father lost the nationality before January,1, 1963), through a written document to obtain recognition of French nationality.

“The order asked state representatives in the French provinces to ensure that these persons, while approaching administrative services, had no difficulties and obstacles to stay in France in order to complete the procedures for recognition of nationality”.

French senator asked in her request that there are cases of persons who were born in Algeria after the date of March,19, 1962 (cease-fire) of parents born in Algeria before the date of the declaration of independence, and who have a brother and sister who were born later in France after they settled with their families on the French soil, as the first segment found itself without French nationality and the second enjoyed it, even if they are of the same family.

French parliament, in its two chambers, had overturned the Amendment No. 74, which was incorporated into the Citizenship and Equality Act in October 2016, and which provided for the granting of French citizenship to Algerians who were born before January 1, 1963, and who lost it from that date.

French National Assembly “Parliament”, added that the amendment was withdrawn without specifying the reasons for the withdrawal from the list of the adopted amendments, as the list, which was checked by Echorouk, contains no amendment, which means that the discussion of the law that will be launched in the French Senate by next October 4, will not include this proposal.

In view of the original text of the amendment, it stated that persons who were born before January,1, 1963 in France or in the overseas territories or provinces remained subject to French sovereignty at the time or to one of the parents who were born in Algeria and who lost French nationality on January,1, 1963, by written request both in France and abroad.
