Owners Of Chaotic Building To Pay Fines Of Up 50% Of Property's Total Value

Government took new measures to settle the positions of buildings that have been completed or that are under construction, and which are not conform to the content of the construction licence, and this by requiring owners to pay fines ranging from 20 to 50% of the total value of the property, in a complementary step to the Settlement Act on buildings that are not completed, and which froze the operations of renting and exploiting real estate.

At the time when thousands of owners are waiting for the settlement of their buildings’ status, that were built before the year 2012, and the answer of their demands positively or negatively, the executive branch brought, through the Finance Bill which was referred to the National People’s Congress for discussion and approval, a new legal article in the same context of the law, which closed doors of receiving files last August,3.

Article in its content asserted that the status of the buildings that have construction license can be settled, both for buildings that have been completed or buildings that are under construction and that are not conform to the content and instructions of the construction permit, provided that they respect the rights of neighbors with regard to determining the construction site, opening, standards of construction, security, and the end of the term that is specified for works under the amended construction license with the settlement title that is granted after the approval of the committee that is created for deciding in the settlement requests.

Settlement is carried out in accordance with the Legal Article, with the payment of a fine ranging between 20 to 50% of the property value, according to the nature of the offense, that is, of the property worth a billion centimes value of, for example, the penalty will range between 200 to 500 million centimes, a rate which is first subject to the committed offense and the estimate size, and it is also subject to the total value of the property.
