Terms, Conditions For The Acquisition, Exploitation, Waiver Of Sensitive Equipment

Five ministries defined the conditions and modalities of acquiring, possessing, exploiting and relinquishing sensitive equipment, as dealerships are required to obtain licenses for their acquisition and compliance with the technical specifications, and customs authorities are required to supply the Ministry of Defense with the list of equipment that are purchased from the foreign market every 3 months, indicating the quantity, type, brand, type and serial number.

According to the content of a joint ministerial decision, the application form for the license to purchase sensitive equipment from the national or foreign market must be submitted by the client to the concerned ministry or the state of the activity, and a license copy of the applicant must be attached to the country of origin of the equipment and the country from which it is imported, and after ascertaining the conformity of the application, the latter shall be sent to the authority that is charged with preparing the license within five days following the filing date.

The responses to the application for the license shall be communicated to the concerned person in accordance with the same decision by the services of the State where the application or the concerned ministry are lodged, as the case may be for 60 working days from the date of filing the application.

According to the joint ministerial decision, the company of sensitive equipment is based on the original purchasing license, in order to put it for consumption. 

Customs authorities are obliged to put a stamp stating that the license was consumed and arranged by the equipment company, specifying the serial number of the imported equipment.

Customs shall also send the list of equipment that is obtained from the foreign market every three months, indicating the quantity, type, logo, model and serial number of the equipment for the license, which in turn communicates with the National Defense and Interior Ministries.

The conditions that are set forth in the resolution include a student information form, a residence document for foreign residents, a descriptive inventory of the means to keep the equipment subject to the request and a copy of the equipment utilization license when the request relates to the acquisition of sensitive equipment that is classified in sub-sections 1, 2 and 3 of section “A”.

As for the legal persons, in addition to the information form, the owner of the institution or company is subject to a descriptive inventory of the means to maintain the equipment that is subject to the application, and a residence permit for foreign nationals, together with a copy of the equipment’s utilization license when the request relates to the acquisition of sensitive equipment that is classified in sub sections 1, 2 and 3 of Section “A”, and for the central authorities or departments with central management and public institutions that belong to the energy sector, the application for the license shall be filed with the concerned Ministry’s departments in exchange for a receipt.

License for the use of sensitive equipment that is classified in section “A” is renewable for a period of 5 years for the sensitive equipments that are classified in sub-sections 1, 2 and 3 years that are renewable for the sensitive equipment that is classified in sub-section 3, and no change in specifications and characteristics of the equipment that is specified in the license for acquisition or exploitation only after obtaining a license from the competent authority.

In case of changing the residence or location of the activity, the holder of the sensitive equipment for the purposes of use that are classified in sub-sections 1, 2 and 3 of section “A”, the declaration shall be authorized by the competent authority for the exploitation license and the competent security services of the region of jurisdiction, can only be exploited by a public network operator for satellite communications.
