Constitution drafted in French, Presidency should rectify translation mistakes, Law Experts say

Algerian Law Experts think that the rejection of the condition of parental involvement in anti-revolution acts for those who run for the presidency, from the Arabic version of the draft constitution, was signed intentionally, in order to force the revolutionary family to participate strongly in the debate on the Constitutional amendment, because of concerns about the text which may not be accepted by the political class.

This subtraction is supported by a former member of the Constitutional Council, Ammar Rekhila, who criticized initially adopting the project in the French language, and in the drafting of bills, while the origin is the adoption of the Arabic language.
“Texts are drafted in French and then translated into Arabic, this is why there are errors, which explains the drop of the seventh item of Article 73 in the draft constitution, which provides for the prevention of each person whose parents contributed in acts against the revolution, from running for the presidency, was written intentionally and not accidentally in order to lure the revolutionary family, and force it to engage in the debate on the draft constitution.”
“Power wants to attract attention of the political parties, civil society and also national figures. Omission of this item when translating the project into Arabic, was only a taste, because of precedent beliefs that the political class will not participate in the discussion of the draft constitution. Maintaining the condition of the enjoyment of parents of Algerian nationals to accept the file to run for the presidency, could raise an intellectual, political and legal controversy”.
“Deleting the seventh item of Article 73 of the Constitution, with the election law, which requires the non-participation of parents in anti-revolution act confirms that the omission is not final, so the intent in this case was very specific, which is forcing the revolutionary family to discuss the draft constitution, as amended, but until the issuance of clarification in Arabic. This condition is considered lapsed”.
This view is supported by a former chairman of the Legal Affairs’ Committee, Mohamed Kenai, who told Echorouk in phone conversation, that the origin of the laws is Arabic, but the first formulation is made in French, but the text is written in Arabic when phrased for application and not vice versa. 
“We hope that the error had occurred intentionally, not deliberately, and that can be rectified. All the texts are written in French, then translated into Arabic, which means that the text of the Constitution was written in French and then translated into Arabic.”
