Examining judge postpones the hearing of Gen. Ben Hadid

Algiers Sidi M’hamed Court’s Sixth chamber judge postpones on Monday the hearing of the retired Gen. Houcine Ben Hadid, who is jailed in Harrache prison, after his defense appealed the order of detention that was issued by the public prosecutor and the investigating judge at the same court.

Judicial sources revealed that the appeal at the Indictment Chamber at Sidi M’hamed court, and in accordance with Article 127 of the Penal Code, which allows the accused or his lawyer to ask for the release from the investigation judge all the time he can refuse, because Article 62 of the Penal Code, in the fourth paragraph, that is classified as contributing in the project of weakening the morale spirit of the armed forces or the nation, and which purpose is harming the national defense as an offense, and on this basis, the release of Gen. Ben Hadid and placing him under judicial control is not possible.
In this context, one of Ben Hadid’s lawyers, Professor Bachir Mechri, told Echorouk, that he is collecting evidence and clues that prove that his client is not guilty, especially with regard to trying to discourage the armed forces, saying that they gave a copy of the conversation between Ben Hadid and the web radio, as they received written statements of the web radio “Radio Maghreb”, and “in any case” he adds, the investigation will show the truth.
Defense lawyer of the retired General Ben Hadid, who is placed in temporary detention of Harrache, will drop the second charge relating to the possession of a weapon and war ammunition, because “He has a legal license and ammunition are a some bullets only”,stressing that his family presented all the necessary documents.
