Traffic Accidents, Drug Addiction To Be Included In Judicial Records

Justice Minister, Tayeb Louh, announced the presentation of a draft law on the review of the provisions of the judicial records in the coming days before the Council of Ministers.

He added, on Sunday, during the presentation of the draft laws on the competence of the State Council and the organization of prisons before the deputies of the National People’s Assembly, that the government approved a draft law on the review of the judicial records, and it will be presented in late December to the Council of Ministers, such as traffic accidents, drug and alcohol addiction in the judicial record. In addition to other amendments that will be announced soon.

The Minister of Justice recalled, in introducing the draft law on the organization of prisons, under the electronic monitoring system, which was included within the legal system in 2015 as an alternative to temporary imprisonment, by carrying the sentenced person to an electronic bracelet that intended to allow his or her presence to be known at the place of residence that is determined in the status order that is issued by the judge who apply the penalties.

This text aims at the social reintegration of the beneficiary, by serving his/her sentence or what is left of it outside the penal institution and thus reducing cases of return to crime.

One of the most important provisions of the draft law is to expand the electronic monitoring system for the convicts to adapt this punishment. 

The purpose of this procedure is to carry the convicted to an electronic bracelet that allows his or her presence to be determined by the judge to enable the person to serve his sentence or part of it, including outside the penal institution, in respect of the dignity, integrity and privacy of the person in question.

The procedure also includes taking into consideration, when determining the times and places that are included in the judge’s decision, the convicted person’s practice or follow-up of the study, formation, treatment, entrapment or exercise of a job. 

The implementation of this procedure, by the external services of the prison’s administration that are responsible for the social reintegration of the detainees, who must immediately inform the judge of any violation of the judicial monitoring period, and send periodic reports in this regard.
